Topgolfs complex given approval by KY court

A lower court’s ruling has been upheld by a panel of judges assigned by the Kentucky Court of Appeals, giving Topgolf the go ahead to construct a complex at Oxmoor Center.

The original suit was made by area neighbors opposing Topgolf’s proposed development. The three couples who brought the suit engaged Louisville land-use attorney Steve Porter to appeal Circuit Court Judge Ann Bailey Smith’s decision in favor of Topgolf.

The original suit as well as the appeal were based on the argument that Topgolf was not licensed in the Commonwealth of Kentucky to conduct business at the time it filed its application. Porter also argued that the project violates Louisville’s land-development code and comprehensive plan.

Topgolf’s attorneys maintained that Topgolf International’s director of real estate, Tanner Micheli, is the actual applicant and was upfront during the process, speaking to the media and at public hearings. The city’s Metro Council and Planning Commission approved the Topgolf project following hours of public hearings attended by hundreds of those both in favor of and opposed to the company’s plans.

Some organizations, such as the metro chamber of commerce and Greater Louisville Inc., view Topgolf coming to Louisville as a sign of economic growth for the city.
