The recent drought has pitted numerous Carlsbad homeowners and their homeowners’ associations against each other, but the battle has been decided in favor of homeowners by a law Gov. Brown signed on September 4.
A bill created by Assemblywoman Lorena Gonzalez, (D-San Diego), specifically to help homeowners deal with the effects of the recent California drought, will prevent home owners associations (HOA) from enforcing certain HOA rules.
HOA’s place restrictions on their members to ensure a degree of uniformity in a neighborhood and maintain property values there. In the case of the bill Gonzalez put forward it was the banning of artificial turf that was in play.
Due to drought conditions more families are seeking to replace their grass with artificial turf, and now, thanks to the recently signed bill, their HOA cannot take action against them for doing so. When the drought is over, although home owners will no longer be able to make the switch from grass to turf, those that have already done so cannot be forced to return to grass.
Savvy businesses that deal with selling and installing artificial turf would be wise to have their local Print company produce a Brochures outlining their services and products as well as including information about the newly enacted law. The new law is considered an urgent measure that means it goes into effect immediately.
